Using the Innocence Framework to Improve Due Process Protections in the Interrogation Room

In this session, you will learn how to effectively investigate and litigate cases in which your client falsely confessed to the crime. False confession cases are notoriously difficult to undo but the Innocence Movement has proven that they are not impossible to win. In particular, this session will focus on how to make a compelling case that your client’s case is not reliable and why that is relevant to the court’s constitutional analysis of the admissibility of the confession. Specifically, we will discuss the investigation and step-by-step analysis of a confession, how to most effectively use experts in a confession case (including not only psychologists, but also police practices experts), and how to argue that the (un)reliability is relevant to the admissibility of the confession.
