Many prosecutors are trying harder than ever to uphold wrongful convictions, even in the face of evidence of innocence. They vigorously defend wrongful convictions in post-conviction hearings, pursue reversals of exonerations though appeals, and/or they seek to retry an innocent client after a vacatur of the conviction. Post-conviction hearings, appeals processes, and retrials can take years and present risks. This session will explore the growing guilty plea problem in the post-conviction context, and will include the perspective of two clients who took a plea deal to avoid endless litigation and their attorneys who represented them during the process.
