Federal habeas corpus procedure can often seem like a complex maze purposely designed to exclude as many claims as possible. It may well be, but by keeping a handful of key rules and concepts in mind, litigators can ensure they protect their federal claims, properly exhaust them in state court, and present them in a manner that maximizes the chances of relief. This session will cover the nuts and bolts of federal habeas procedure, focusing on specific key concepts such as procedural default, statute of limitations, exhaustion, certificates of appealability and the standards for successive habeas petitions. It is intended for habeas practitioners of all experience levels.
