Building a Strategic Litigation Program

With over 350 post-conviction DNA exonerations to date, a growing number of Network partners are leveraging the lessons from these cases for systemic reform through the courts. This session will highlight two strategic litigation initiatives for Network partners interested in collaboration or in developing their own impact litigation agendas. From the perspectives of both a new initiative at the Arizona Justice Project as well as the five-year-old Strategic Litigation Department at the Innocence Project, the session will cover strategies for developing a docket, identifying promising test cases, and working with expert witnesses. By way of example, the presenters will share their experience litigating cases involving unvalidated forensic science evidence and discuss several new databases developed by the IP’s Strategic Litigation Department for tracking national trends in this area of law.
